Subdivision Administration and Restrictions on Title
Section 173 agreements etc.
We can administer the subdivision by making applications to referral authorities, liaising with Solicitor and Council regarding any Section 173 agreement requirement, and chasing down compliance from Referral Service authorities relating to Council issue of Statement of Compliance for the Subdivision.
Some experienced clients may choose to attend to the above themselves, whilst other clients prefer us to attend to this.
Consolidation of Titles
Latest State Government laws have been introduced that impose a land tax on each of side by side lots, even though both lots could be construed as one contiguous lot. (ie: dwelling on one lot, tennis court on adjacent lot under same ownership)
CDC can readily process plans of Consolidation of Titles at Council, which in turn are lodged at Land registry for registration.


Boundary Re-Alignment Subdivision
A Boundary Re-alignment subdivision involves moving an existing boundary between two adjacent parcels of land without creating any new lots. This subdivision can generally be more quickly processed at Council via a VICSMART Planning application and Council delegate certification.
Boundary Re-Alignment Subdivision
Application Surveys pursuant to the Transfer of Land Act occur when a Title Re-establishment Survey has revealed a significant discrepancy between the Title Boundary on your Certificate of Title and the boundary occupation on site (ie: fencing / building).
Adverse possession is a legal principle that enables the occupier of a piece of land to obtain ownership, if exclusive possession of the land for at least 15 years can be proven.
